In 1988, the Food and Drug Administration Act by the U.S. Congress officially established the U.S. Food and Drug Administration (FDA) as an agency of the Department of Health and Human Services (HSS),

The Commissioner of Food and Drugs is appointed by the President with the advice and consent of the Senate, and broadly spells out the responsibilities of the Secretary and the Commissioner for research, enforcement, education, and information.
